1. Ordering and Acceptance
- Any quotation or price list issued by the Company shall act as an invitation to treat only.
- All orders placed by you are an offer to purchase the Goods subject to these Terms.
- Acceptance of delivery of the Goods shall be deemed conclusive evidence of your acceptance of these Conditions.
2. Price and Payment
- The Company reserves the right to vary any of the prices in its published price lists without prior notice.
- Payment in full is due as specified on the invoice. If you fail to pay any amount on its due date, the Company reserves the right to suspend and/or cancel any outstanding deliveries.
- Taxes and duties imposed by government or local authority will be borne by the Customer, unless otherwise agreed.
3. Product Suitability and Warranties
- The Goods supplied are intended to conform with the general description or specification provided by the Company.
- Customer Responsibility: The Customer shall be solely responsible for specifying and selecting the Goods and satisfying itself that the Goods are of the correct description, type, and fitness for the Customer's specific purpose or animal's condition.
- Disclaimer: Goods invoiced or supplied are not sold as fit for any particular purpose, and any term, warranty, or condition, express or implied, to the contrary is hereby excluded. The Customer relies on their own judgment regarding the suitability of the products.
4. Delivery, Title, and Risk
- The Customer shall take delivery of the consignment from the respective Feed Plant or warehouse and arrange for its carriage to its selling points or farm at its own risk and cost.
- Risk of loss or damage to the Goods passes to the Customer upon collection by or delivery to the Customer or their designated carrier ("Ex-Feed Plant" basis).
- The Company will not be responsible for any loss, shortage, or damage during transit.
- The Customer must satisfy himself as to the state of packing and quality of feed at the time of taking delivery; no complaint shall be entertained after delivery is effected.
5. Returns and Cancellation
- The Company is under no obligation to accept the return of Goods.
- If the Company, at its sole discretion, agrees to accept the return of goods, the Customer shall be liable for a restocking charge (e.g., 15% of the total invoice cost).
6. Intellectual Property Rights
The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, logos, designs, and images) are owned by the Company or its licensors and are protected by copyright, trademark, and other intellectual property laws. You must not modify, reproduce, or use any materials from this site without our prior written permission.
7. Limitation of Liability
In no event shall the Company, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Website or the Products, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, loss of profits, or loss of business.
8. Governing Law and Jurisdiction
